Personal Injury Claims for Work Related Accidents

posted on 3 June 2011

More days home from work in the UK are caused by lumbar sprains and muscle strains than anything except the cold. The latest figures that have been released from the Health and Safety Executive show more than 23 million days of work in 2008 were lost thanks to I'll health. As many as a fifth of those have had back sprains that lead to agonizing chronic conditions. The most susceptible to these injuries are workers in construction, warehouse, factory, and production line settings. Although construction and jobs that involve heavy physical exertion tend to have more back injuries, no industry is impervious to these risks. Many back injuries actually occur in office workers, nurses, delivery drivers, gardeners, and caseworkers. Manual handling is the number one cause of back injuries in the workplace. The term manual handling includes repetetive lifting and the lifting of heavy objects. Many times, these injuries occur due to the employee not properly lifting with his knees and instead using his back. Injuries can also occur when the weight is carried in a position that is too far away from the person's body. There are very detailed regulations for this stuff. It is all outlined very clearly in the Manual Handling Operations Regulations 1992. Back injuries can be caused by many different things. One cause of back injury is the company failing to provide an adequate number of breaks. Excessive dampness or cold are also conditions that can lead to serious issues with the human back. Minor injuries to the back include sprains to the ligaments that support the person's spine. Herniated discs are also not very serious. However, they can be excruciatingly painful. Fractured vertebrates are much more serious injuries that can happen on the job. There can be devastating consequences for these situations. Employers have the responsibility and the serious legal duty to provide their trusting employees with workplaces that are safe. They should always find alternatives to manual handling when they can. Workers also need to be trained on how to correctly perform their tasks. If a company fails to provide safe working conditions and that results in serious injury, that company should pay compensation for the damages that it caused by its negligence. There is no reason why any business should be unable to provide a safe environment for its employees. Anyone who is involved in an accident that results in back injury needs to immediately file a personal injury claim to get the proper compensation.

How To Get Compensation for an Injury

posted on 26 May 2011

The best thing to do to start with is to see your doctor. As soon as you suffer any injury that is not your fault, get a medical opinion. If you have seen a doctor they will have notes of your condition and this will help your case. If you leave it too long after the accident, the defendant may start to say that you could have sustained the injury after the event. Obviously serious injury will require hospitalisation and this will not apply. Once you have been to the doctor, then you will need to get in touch with a company of personal injury lawyers. Choose a firm that is used to dealing with cases such as yours, one that often deals with this type of injury. Try to find one with a good reputation, ask friends and family or read on line reviews and ask for references. It should not take too long to get information about the company and it could make a big difference to your case. You should be able to relax once you have a lawyer on the case. They will get in touch with you when they need you to complete forms or send documents which will make up the evidence for your case. They may even be able to settle out of court and you will not even need to go in front of a judge to get your compensation allocated. It can all be quite a simple process and worthwhile if you get the compensation you deserve for the injury that you have sustained. It is worth deciding sooner rather than later if you want to make a claim for compensation. The quicker you start the proceedings, the quicker you will get your compensation. You will then be able to start to forget about the accident and start to concentrate on recovering and enjoying life again

The pain that children go through in the hands of a parent

posted on 7 April 2011

There are predicaments that children should ever be required to go through. Children are very strong little people and they are smart too. When they go through something really bad, they have mechanisms to deal with the pain and no child should be allowed to go through that. It is even worse if it is a parent who is inflicting that kind of pain. There are reported instances where fathers have abused their baby girls and even baby boys and the kids got scared to tell their mothers. This is because they are brought up to believe that they can trust their parents and if a parent betrays that trust, then they do not know how to interpret that. In most cases, the mother notices a change in the way a child relates to the father and with thorough scrutiny finds that he has harmed the child. This causes her to divorce him immediately and parents custody rights does not apply to someone like him. And this is because he is an endangerment to the welfare of the child and the mother will not let him near her child again but he will be required to support his child financially.

Fathers have a right to decide about his childrens' education

The education system and where a child should go to school lies in a number of reasons. The first thing to know is that by the time a child goes to school for the first time the parent should have watched what the child seems to like and is good in and what they excel in in terms of sports and be able to make a decision based on this. If you have been seeing that your son or daughter loves singing, it is good to take him or her to a school where their talent can be nurtured. If they like drawing on the ground or on paper and you can see that their interest is in that, it should be wise for you take them to a school that art has a place. One of the rights for fathers is for them to be able to make this decision. He should not be forced to take a child to certain school as long as the child is getting education. One thing to note though is that the child should be going through approved type of education.

JOINT PARENTAL RIGHTS IS THE WAY TO GO

posted on 20 December 2010

A child is born of two parents the father and mother. For this reason it is logical that both of them have parental rights which include providing financially for the upkeep of the child, protecting the child and supporting them in all areas. Where joint parental rights are exercised, the child is able to enjoy support from parents which is very crucial for a child growth. These can happen whether the parents live together, are separated or divorced. In instances where the parents are living separately they may agree to cater for the child jointly even though for one reason or the other, they can not live under the same roof. This calls for the parents to reason beyond their differences and offer what they are bound to give to their child. This takes great consideration and swallowing of pride to the parent who is the child's custodian. It is also not easy for the other parent but on putting the interest of the child first it becomes a thing to look forward to. If you are in a situation like this and you do not know how to go about having joint parental rights, talk to a lawyer dealing with family law.

When our parents do the wrong things…

posted on 3 November 2010

A family is a central unit of the society but what if the main components of a family are misbehaving badly? Our parents should be our guide in walking our way through life but what if they are the ones leading us on the other side? A lot of families are dysfunctional because the head of the family is cheating on his wife and she is not interested at all as long as she has Black Label, Jose Cuervo (Tequila) and its other associates by her side. Children who see this kind of behavior from their parents tend to be swayed as well, thinking it must be the norm as their parents are doing it. Fortunately because of the recent cases received by the Department of Social Welfare and Development (DSWD), the government now has the right to revoke parental rights from parents who are not setting a good example to their children. Once revoked, the children will be under the agency&rsquos custody until a legal guardian from either family acknowledges the responsibility. This is to demonstrate to the parents that they should be responsible for their children and their welfare. Deliberations or private hearings are being held to confirm if one or both parents can still regain parental rights if situation improves. According to an insider in DSWD, surprise inspections and at times private investigations are being made to check that the child is being properly taken care of by the parents. This is just one of the many programs implemented by President Obama to ensure that the parents get the message loud and clear, especially for the children.
