•What are work accident claims?
Every business owner will often face a work related injury from their employees. Work accident claims usually happens when there are a lot of employees. Basically if you own a chocolate factory you have a lot employees that can get injured. For example, if an employee slips and breaks their leg, he/she is covered from the workmans compensation plan that you have. All medical expenses, labratory costs and the days that your employees had missed working due to the injury, he/she is fully covered with their salary. If you don't have any coverage for your business, you as a business owner is fully responsible for all of the expenses that was caused inside of your business premisis.
•What if the employee has a fraudulent claim?
Insurance companies have their own way to investigate fraudulent claims. They know for a fact based on the medical exam results. They can easily determine if the claim is fradulent or not. If they find out that the claim is legit they are willing to settle the claim with a day or two, but if the claim is fraudulent, the employee will be terminated instantly. This scenario often occurs so you don't have to worry about anything, because the insurance company has specific adjusters that handles this type of claim.
•Can you sue the employer?
Business owners are exposed to major lawsuits, especially businesses that put their employees in danger. Business owners are obligated to settle any lawsuits with their employees once an employee proves that there is a legitimate claim. Employers will not even waste their time and money to argue with an employee that proves there is legit claim. It is strongly recommended for a business owner to have a workman's compensation coverage that is in forced at all times. Having workman's compensation coverage will give you a business owner the peace of mind in case of any claims. Furthermore, it is actually a requirement from the Department of Labor, that if you employ two or more employees, you must have an existing workman's compensation coverage. You can also acquire this kind of coverage from insurance companies that handles your liability insurance.
